What Does It Really Mean to Own Property?

What does it mean to truly own something if the government maintains an ongoing claim on it?

Northwood University Professor Alex Tokarev and alumna Kristin Tokarev examine that question in new thought leadership published by the Independent Institute, exploring the relationship between taxation, private property and individual liberty.

In “You Can Buy a Mansion, But Can You Really Own It?”, the Tokarevs argue that property and estate taxes do more than generate government revenue. They can influence where people live, where entrepreneurs invest and what families are ultimately able to pass from one generation to the next.

The authors open with a striking example: a dispute over whether a wealthy businessman was legally domiciled in Florida or Connecticut eventually resulted in his heirs facing $13.2 million in estate and gift taxes. From there, they examine other examples, including Los Angeles’ tax on high-value property transfers and proposals to tax accumulated wealth.

Their broader argument reaches beyond any single tax or taxpayer. At stake, they contend, is a foundational principle of a free society: private property rights.

“The question isn’t whether the taxman can successfully bleed the rich,” the authors write. “The question is whether the government should have a perpetual claim on things that belong to you and me.”

That question reflects themes central to The Northwood Idea, which recognizes private property as essential to individual freedom, economic opportunity and a flourishing free society.
